REFUND POLICY

(Effective Date: October 1, 2025)

This Refund Policy (“Policy”) outlines the conditions under which Foodistic Marketing Services Pvt. Ltd. (“Dely Cart”) processes refunds for products purchased by Buyers (“you”, “your”). By placing an order, you agree to this Policy.

1. Eligibility for Refund

Refunds are valid in cases of successful product returns, undelivered shipments (RTO), order cancellations within permitted timeframe, or delivery of wrong/damaged/expired products. Non-refundable cases include incorrect addresses, refusal of delivery, damages after delivery, and non-returnable products.

2. Refund Process

Buyers must initiate refund requests through the app/website (“My Orders” or Support) or via customer support. Supporting documents such as photos, invoices, and delivery notes may be required. All requests are verified by Dely Cart’s operations team. Fraudulent claims will lead to account suspension and legal action.

3. Mode of Refund

Refunds are processed either to the original payment method (bank account, UPI, card, etc.) or to the Dely Cart Wallet (if opted by the Buyer). Wallet refunds cannot be withdrawn as cash unless mandated by law.

4. Refund Timelines

Refunds to original payment method: 2–6 business days (depending on bank/payment gateway). Refunds to Dely Cart Wallet: within 24–48 hours. Delays due to banks, intermediaries, or force majeure events are beyond Dely Cart’s liability.

5. Partial Refunds

Partial refunds may apply in case of wrong/defective/damaged items delivered in part of the order. Refund value is adjusted proportionately, excluding shipping unless the error is by Dely Cart or its logistics partner.

6. Adjustment of Promotional Benefits

If promotional discounts, coupons, or reward coins were applied on an order, refunds will be adjusted accordingly. Freebies and samples must be returned; otherwise, their value may be deducted from the refund.

7. Governing Law & Jurisdiction

This Policy is governed by Indian law including the Indian Contract Act, 1872, Consumer Protection Act, 2019, and IT Act, 2000. Courts in Azamgarh, Uttar Pradesh shall have exclusive jurisdiction over disputes.
