CANCELLATION POLICY

(Effective Date: October 1, 2025)

This Cancellation Policy (“Policy”) governs the rules for cancelling orders placed on the platform operated by Foodistic Marketing Services Pvt. Ltd. (“Dely Cart”). By using our services, you (“Buyer”, “you”, “your”) agree to comply with this Policy.

1. Eligibility for Cancellation

A. Buyers may cancel orders within 2 hours if not processed. B. Some products like perishable goods, final sale items, or custom products are non-cancellable. C. This policy follows Indian laws including the Contract Act 1872, Consumer Protection Act 2019, and IT Act 2000.

2. Process of Cancellation

A. Cancellation requests can be made via the Dely Cart app/website under “My Orders” or by contacting support. B. Once approved, confirmation is sent via email/SMS. C. If cancellation is rejected (e.g., order shipped), Buyer will be notified. D. Processing usually takes 2–3 business days.

3. Refunds for Cancelled Orders

A. Eligible cancellations receive full refunds (excluding shipping or convenience fees unless error is on Dely Cart). B. Refunds to bank accounts take 2–3 business days, wallet refunds within 24 hours. C. Refund status is communicated by email/SMS. D. Refunds follow Indian Contract Act 1872 & Consumer Protection Act 2019.

4. Buyer Responsibilities

Buyers must provide accurate order details, avoid excessive cancellations, and cooperate in cancellation processes. Repeated misuse may result in suspension or termination of account.

5. Cancellation by Dely Cart

Dely Cart may cancel orders for reasons like out-of-stock products, pricing errors, fraudulent transactions, or unserviceable delivery locations. In such cases, Buyers will get full refunds.

6. Force Majeure

Dely Cart is not liable for cancellations affected by natural disasters, pandemics, strikes, government restrictions, or technical failures beyond its control. Refunds will be processed once normalcy resumes.

7. Governing Law & Jurisdiction

This Policy is governed by Indian law. Courts in Azamgarh, Uttar Pradesh will have exclusive jurisdiction. Disputes should first be raised with Customer Support or through grievance redressal.
